Sheltering Arms is seeking to hire  a Attorney for our Foster Care and Adoption department. The Attorney will act as an in-house legal resource for the Foster Care and Adoption Department. The Attorney will support the ongoing compliance of the agency and accurately represent clients by: Attending court proceedings, reviewing court orders, filing petitions, and responding to legal inquiries. The Attorney will also act as a key component in the education of staff and management regarding best practices in court proceedings and providing preparation for testimony.

 

Essential Functions:

  • Review all court orders issued against the agency in order to review and decide on the necessity of appeal
  • Represent the agency by attending court hearings when an NRE has been issued
  • Collaborate with FCLS and other external legal representative to ensure the interests of the agency are being met
  • Conduct discovery, hearings, TPR trials, depositions, oral arguments and court conferences as necessary
  • Draft and file TPR petitions
  • Appear in court on cases involving FCLS to ensure proper representation of the agency
  • Train all staff on court procedures, testimony, etc., including preparation for testimony in TPR proceedings
  • Attend FTC’s where BP’s are represented by counsel
  • Review court orders to ensure that the agency is in full compliance
  • Conduct appellate work if TPR is appealed
  • Consult with Administrative Supervisors and on cases that pose legal challenges
  • Meet with agency supervisors to assess cases for rising causes in action on a monthly basis
  • Review court reports in high profile matters
  • Attend all departmental meetings, agency meetings, and external trainings
  • Oversight of staff and adoption as assigned
  • Promptly respond to legal inquiries
  • Submit quarterly reports to the Director of FC&A and Assistant Executive Director, Child Welfare Services on TPR and Adoption Progress
  • Consult with Diligent Search Coordinator
  • Other duties as assigned
  • Implement a legal tracking system for court dates and due dates for legal documents

Qualifications:

  • New York State Bar admitted
  • At least 5 years experience in the field
  • Knowledge of ACS a plus
  • Strong knowledge of Child Welfare and Family Law
  • Exceptional written and oral communication skills

Physical Requirements: Must have the ability to complete all standard administrative and support tasks including but not limited to climbing up and down stairs, operation of computers/phones/fax/printer/copy machine, and the ability to lift boxes, furniture, and equipment up to 30lbs. Must be able to travel from the various locations and sites of Sheltering Arms.
